Regulations

Why State Requirements Vary

Telehealth is regulated at the state level. Each state has its own medical board, prescribing laws, and telehealth requirements that determine how online healthcare services may operate. These regulations are independent of Open Water Rx and are subject to legislative and regulatory changes.

State Medical Board Rules

Each state's medical board sets standards for telehealth practice, including whether synchronous video visits are required, what documentation is necessary, and how provider-patient relationships must be established.

Prescribing Laws

Some states impose additional restrictions on the prescribing of certain medications via telehealth, including compounded GLP-1 receptor agonists. These laws may limit which formulations are available in specific states.

Treatment Pathway Restrictions

Certain states restrict specific treatment pathways or require additional informed consent documentation before weight-loss medications may be prescribed through telehealth channels.

Evolving Regulations

Telehealth regulations continue to evolve. States periodically update their requirements in response to public health needs, legislative changes, and medical board policy updates. Our platform adapts automatically.

Clinical Review

How Provider Review Works by State

The provider review process is consistent in quality but may differ in delivery method based on your state's requirements.

Asynchronous Review

In most states, after you complete your online health evaluation, an independent licensed provider reviews your case within 24-72 hours. The provider examines your full health profile, medical history, medications, and goals before making a clinical determination.

Synchronous Video Visit

Some states require a brief live video consultation before a prescription can be issued. If required, the video visit is scheduled at your convenience, conducted through our HIPAA-compliant platform, and is included in your program at no additional charge.

Independent Decision

All prescribing decisions are made solely by your independent licensed provider based on your individual health profile. Open Water Rx facilitates the process but does not direct, influence, or override provider clinical judgments. A valid patient-provider relationship must be established before any prescription is issued.

Provider review timelines may vary based on case complexity, state requirements, and provider availability. You will receive a clear decision and next steps regardless of outcome.

Delivery

Shipping Is Available Nationwide if Prescribed

If your licensed provider determines that a prescription is clinically appropriate, your medication is prepared by a licensed compounding pharmacy and shipped directly to your door. Shipping is available to any valid U.S. address for prescribed medications, though which medications can be prescribed depends on your state's regulations.

Discreet Packaging

Plain, unmarked packaging with no external branding or medication labels visible. Your privacy is protected at every step.

Cold-Chain Shipping

Refrigerated medications ship with appropriate cold-chain packaging to ensure efficacy during transit.

Licensed Pharmacies Only

All medications are prepared by licensed compounding pharmacies that comply with federal and state regulations.

Delivery Timeline

Shipping timelines vary by pharmacy and location, typically 3-7 business days after prescription is issued. Tracking is provided.

Shipping is included in your monthly plan price. There are no separate shipping fees or handling charges. You must provide a valid U.S. shipping address where you can receive packages securely.

Limitations

Why Some Programs May Not Be Available Everywhere

State regulations and clinical requirements may limit access to specific programs or medications in certain locations.

Medication-Specific Restrictions

Some states restrict the prescribing of specific compounded medications or formulations through telehealth. These restrictions may apply to certain GLP-1 receptor agonists or specific dosage forms. Our platform automatically determines which medications are available in your state.

Informed Consent Requirements

Certain states require additional informed consent documentation or specific disclosures before weight-loss medications may be prescribed. These requirements are built into our intake process and are handled automatically.

Provider Licensing

Providers must be licensed in the state where the patient is located at the time of the consultation. Provider availability can affect which programs are currently offered in specific locations.

Treatment Pathway Restrictions

Some states impose restrictions on specific treatment pathways, such as weight-loss medication prescribing, that may limit program availability. These restrictions are independent of Open Water Rx and are based on state law and medical board policy.

Not all programs are available in all states. Our platform automatically determines which programs and medications are available based on your state of residence during intake. If a specific program is not available in your state, alternative options may be discussed with your provider. Contact our support team at members@openwaterrx.com for current availability information.

What to Do Before Starting Your Intake

A little preparation ensures a smooth intake process and accurate provider review.

Gather Your Health Information

Prepare Your Technology
